How do I clear a pest violation that's already overdue?

Look the violation up on HPDONLINE before you pay for anything. If HPD has already reinspected and observed the condition corrected, the violation shows a status of Defect, and there is a documentation route that costs nothing.

If the condition has not been observed corrected, a Dismissal Request with the applicable fee is required. HPD's AF-6 Pest Affidavit of Compliance runs through both routes, and it sets a second condition alongside the inspection: that the required integrated pest management work practices were used to correct the condition. Either way, the work has to be done first.

Check the status first

HPD's own instruction for overdue pest violations is to determine whether it has already inspected. Enter the property address on HPDONLINE and read the violation's status. If HPD has inspected and found the work properly completed, the violation will be in DEFECT status.

That single check decides which of the two routes below applies, and one of them is free.

The two routes

Documentation submission

Where HPD has already reinspected and observed the physical condition corrected, but documentation is still needed to close the violation.

HPD describes this as a free process, generally applying to lead-based paint, mold and pest violations showing a Violation Status of Defect on HPDONLINE or in department records.

For pest violations, submit AF-6 together with the documentation required for a pest certification. HPD's Indoor Allergen Hazards page lists the specific documentation requirements.

An owner who files a Dismissal Request on a violation already showing Defect status may be paying for a reinspection when HPD has already observed the physical correction and a free documentation route is available. The status check takes a minute.

What AF-6 attests

The AF-6 Pest Affidavit of Compliance is the pest-specific affidavit for the overdue stage. The form sets out two conditions, and both have to be met for HPD to dismiss an overdue pest violation.

A. HPD has inspected and found the work properly completed... The violation will be in DEFECT status. If the violation has not already been observed corrected by HPD, a properly completed Dismissal Request form with the appropriate fee must also be submitted to HPD.

AND

B. The appropriate integrated pest management and work practices required by Administrative Code §27-2017.8 and 28 RCNY §54-04(a) were used to correct the condition.

Condition B is the one to sit with. Even at the overdue stage, dismissal turns on whether the required work practices were actually used. The form encloses a description of them, so nobody can say they were not supplied.

The affidavit is sworn under penalty of perjury and notarized. Among the things the signer affirms:

That I have read HPD's "Guide to Local Law 55 of 2018 Integrated Pest Management Practices" and am aware of the work practices required to eliminate mice, cockroaches, and rat infestation safely and in accordance with all applicable laws and rules;

That the work undertaken to correct the above-referenced violation(s) was performed in accordance with the required integrated pest management and other work practices;

That if pesticides were used to abate the presence of mice, cockroaches, and rat infestations, a certified commercial pesticide applicator was used in accordance with New York State Environmental Conservation Law.

Note the conditional in the last one. If pesticides were used. The affidavit does not assume they were, which is consistent with the rest of this framework.

The guide named in item 2 is one page, and it is the document that tells owners to use pesticides sparingly and states that pesticide use cannot and does not replace integrated pest management practices. Read it before signing something that says you have.

Completing and submitting it

The form must be completed by the validly registered owner or agent, after the required work is done, in front of a notary public who signs and affixes a stamp. Where several violations in a single apartment were corrected at the same time, the owner or agent indicates the multiple violation sequence numbers on the one affidavit.

The form directs the affidavit to the Code Enforcement borough office for the building, and lists the addresses, phone numbers and hours. Separately, HPD's Clear Violations page states that as of July 1, 2026 all Dismissal Request applications go to Code Enforcement, Central Violations Administration Unit, 345 Adams Street, 10th Floor, Brooklyn. If you are filing both together, confirm with the borough office where the package should go.

Two forms, two different stages

AF-6 is for violations already overdue or not validly certified. CIV 194 PEST is the timely certification, filed within the certification period. Check the stage before you check the name.

Before you file a Dismissal Request

The inspection is not limited to the violation you are trying to clear

HPD states plainly that new violations may be issued during a Dismissal Request inspection, and that the request can cover all or a portion of the violations existing at the property. You are inviting an inspector into a building. Know what else is visible before you do.

Do the physical work first

The route is a reinspection, so the condition has to actually be corrected when the inspector arrives. That means the §54-04(a) work practices: debris removal, sealing entry and passage points, door sweeps to a quarter inch, and repairing the water sources. An overdue violation is not cleared by paperwork at any stage of this process.

Fees and timing

The fee scales with the building type and the number of open violations at the property, and it is higher for buildings in the Alternative Enforcement Program. HPD's Guide to Clearing HPD Violations sets out the schedule and the inspection timeframes, which run longer in winter than in summer. Confirm the current amount on the application itself rather than from any secondary summary, including this one.

Violation Reissuance

A separate program for older violations at qualifying buildings. Participation allows an owner to certify correction of reissued violations by new certification dates that HPD establishes, which restores the ordinary certification route rather than the dismissal route.

Buildings must qualify, and certain violations are not eligible. HPD's guide describes it as available to buildings with no violations issued in the preceding twelve months, and excludes lead-based paint and buildings in the Alternative Enforcement Program. Review the application before assuming eligibility. There is a separate Certification of Correction of Violations for Reissuance where an owner does not have the original reissuance Notice of Violation.

What can block either route

A Dismissal Request can be rejected for reasons unrelated to the pest condition. HPD's guidance lists pending HPD-related litigation, an uncollected judgment from HPD litigation, and unpaid emergency repair charges.

That last one compounds. If HPD performed work under the Emergency Repair Program and the charge went unpaid, it becomes a tax lien against the property, and it can also block the removal route you are trying to use until the charge is resolved. And filing nothing is its own problem

The code is direct: failure to file the certification establishes a prima facie case that the violation has not been corrected. A building that did the work and never filed is in a materially worse position than the record suggests, and the longer it sits, the more the routes out of it cost.
